Terms & Conditions

1. Acceptance of Terms

By downloading, installing, or using Fitness & Fuel™ ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). The App is operated by VCDS™ (Valhalla Custom Design Studios), a South African business based in Heidelberg, Gauteng.

If you do not agree to these Terms, please do not use the App.

2. The Platform

Fitness & Fuel™ is a fitness coaching marketplace platform. VCDS™ provides the technology; individual trainers operate as independent service providers and are solely responsible for the coaching services, training advice, and products they offer.

VCDS™ does not provide fitness, health, or nutritional advice. Any AI-generated suggestions (e.g., Klimaat Coach, Afrikaans AI Coach, Snap & Stack) are for informational purposes only and should not replace professional medical or dietary advice.

3. User Accounts

• You must be at least 16 years of age to create an account.
• You are responsible for maintaining the security of your account credentials.
• One account per person. Sharing accounts is not permitted.
• You agree to provide accurate information during registration and onboarding.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans & Payments

4.1 Tiers

The App offers the following subscription tiers:

• Free (R0/month): Basic features including Beurtkrag workouts and Klimaat Coach.
• Fuel (R99/month): Adds Braai Tracker, Hoogtelyn, and AI Coach.
• Fuel Pro (R199/month): Adds Snap & Stack photo-to-nutrition analysis.
• Trainer (R499/month): Full platform access including trainer dashboard.

All prices are in South African Rand (ZAR) and include VAT where applicable.

4.2 Payment Processing

Subscription payments are processed through PayFast (Pty) Ltd, a licensed South African payment gateway. By subscribing, you also agree to PayFast's Terms of Service.

• Payments are recurring monthly unless cancelled.
• PayFast processes your payment securely — we do not store your credit card or bank details on our servers.
• PayFast notifies us via webhook (ITN) when a payment succeeds, fails, or is cancelled.
• A PayFast subscription token is stored to manage your subscription status (cancel, check status). This token cannot be used to initiate new charges.

4.3 Cancellation & Refunds

• You may cancel your subscription at any time from your Profile screen in the App.
• Cancellation takes effect at the end of your current billing period — you retain access until then.
• No refunds are provided for partial billing periods.
• Upon cancellation, your account reverts to the Free tier.

5. SMS Notifications

We use BulkSMS (a South African SMS provider) to send transactional SMS messages to the mobile number you provide. These include:

• Password reset OTP codes
• Booking confirmations
• Subscription activation confirmations

By providing your phone number, you consent to receiving these transactional messages. We do not send marketing SMS. Standard mobile carrier rates may apply for receiving messages. You may withdraw consent by removing your phone number from your profile, but this will disable SMS-based features such as password reset via OTP.

6. Push Notifications

We use Firebase Cloud Messaging (FCM) and Expo Push Notification Service to send push notifications to your device. These include:

• Messages from your trainer
• Booking confirmations and reminders
• Training and eating plan assignments
• Subscription status updates

You can disable push notifications at any time via your device settings. A device push token is stored on our servers to deliver notifications; it is deleted when you log out or delete your account.

7. Trainer Relationship & Liability

Trainers are independent service providers, not employees of VCDS™. VCDS™ is not responsible for:

• The quality, safety, or accuracy of coaching advice or training programs
• Any injury, illness, or damage resulting from following trainer advice
• Products sold by trainers through the platform
• Trainers' compliance with health regulations or tax obligations

Use of any fitness or nutrition advice is at your own risk. Always consult a qualified healthcare professional before starting a new fitness or nutrition program, especially if you have pre-existing medical conditions.

8. Health Disclaimer

Fitness & Fuel™ provides tools for tracking fitness and nutrition data. The information provided through the App, including AI-generated suggestions, macronutrient estimates (Snap & Stack), altitude calorie adjustments (Hoogtelyn), and weather-based tips (Klimaat Coach), is for informational purposes only and is not medical advice.

By using the App, you acknowledge that:

• You are responsible for assessing the suitability of any workout or nutrition plan for your health condition.
• AI-generated nutritional estimates are approximate and should not be relied upon for medical dietary requirements.
• You should seek professional medical advice for any health concerns.

9. Intellectual Property

All content, design, branding, and code of Fitness & Fuel™ is the property of VCDS™ and is protected by South African intellectual property laws. You may not:

• Copy, reproduce, or distribute any part of the App
• Reverse-engineer, decompile, or disassemble the App
• Use the Fitness & Fuel™ name, logo, or branding without written permission

10. Account Termination

You may delete your account at any time from within the App (Profile → Delete Account) or via our account deletion page. When you delete your account:

• All personal data is permanently removed from our systems.
• Active subscriptions are cancelled with PayFast.
• This action is irreversible.

We reserve the right to terminate accounts that violate these Terms, abuse the platform, or engage in fraudulent activity.

11. Limitation of Liability

To the maximum extent permitted by South African law, VCDS™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health, arising out of your use of the App.

The App is provided "as is" without warranties of any kind, express or implied.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa.

These Terms comply with the Consumer Protection Act 68 of 2008, the Protection of Personal Information Act (POPIA) 4 of 2013, and the Electronic Communications and Transactions Act (ECTA) 25 of 2002.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. Material changes will be communicated via in-app notification or push notification.
